1. Agreement to Terms

Welcome to AuralFret. These Terms of Service ("Terms") constitute a legally binding agreement between you and AuralFret ("we," "our," or "us") governing your access to and use of the AuralFret website, applications, and services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. Description of Service

AuralFret is a visual workspace for musicians to explore, learn, and create music through interactive fretboard visualization. Our Service includes:

  • Interactive Fretboard: Visual representation of scales, chords, and note patterns across the fretboard
  • Workboards: Customizable workspaces to organize and save your chord diagrams, scales, and progressions
  • Chord Library: Access to over 10,000 chord voicings with search and filter capabilities
  • AI Chord Generator: AI-powered tool to generate custom chord voicings based on your criteria
  • Scale Explorer: Browse and visualize scales across multiple positions and instruments
  • Multiple Tunings: Support for various instrument tunings and configurations

3. Account Registration

To access certain features, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access

You must be at least 13 years old to create an account. By registering, you represent that you meet this age requirement.

4. Free and Paid Plans

4.1 Free Plan

The Free plan provides limited access to the Service, including one workboard and basic fretboard visualization features. Free plan features may be modified at our discretion.

4.2 Lifetime Access

Lifetime Access is a one-time purchase granting perpetual access to all current and future premium features, including:

  • Unlimited workboards
  • Full chord and scale library access
  • AI Chord Generator with unlimited generations
  • Priority support
  • All future feature updates

4.3 Payments and Refunds

Payments are processed securely through LemonSqueezy. Lifetime Access purchases include a 30-day money-back guarantee. Refund requests must be submitted within 30 days of purchase.

5. User Content and Ownership

5.1 Your Content

You retain ownership of content you create using the Service, including custom workboards, saved chord configurations, and progression arrangements. By using the Service, you grant us a limited license to store, display, and process your content solely to provide the Service to you.

5.2 AI-Generated Content

Chords and voicings generated by the AI Chord Generator are provided for your personal use. You may use AI-generated content in your musical compositions without restriction. We do not claim ownership over AI-generated output.

5.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or attribution.

6. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use automated systems (bots, scrapers) to access the Service without authorization
  • Interfere with or disrupt the Service, servers, or networks
  • Share your account credentials with others
  • Use the AI Chord Generator to generate content that infringes copyrights
  • Attempt to circumvent any access restrictions or security measures

7. Intellectual Property

The Service, including its design, features, code, and content (excluding user-generated content), is owned by AuralFret and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

8. Third-Party Services

The Service integrates with third-party services including Firebase (authentication and data storage) and LemonSqueezy (payments). Your use of these services is subject to their respective terms and privacy policies.

9. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. For Lifetime Access holders, we commit to providing core functionality or a prorated refund if the Service is permanently discontinued.

10. Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination:

  • Your right to access the Service ends immediately
  • We may delete your account data after a reasonable retention period
  • Provisions regarding intellectual property, limitation of liability, and dispute resolution survive termination

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO GUARANTEES REGARDING THE ACCURACY OR COMPLETENESS OF CHORD VOICINGS, SCALE PATTERNS, OR AI-GENERATED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURALFRET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless AuralFret and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or Service notification at least 30 days before taking effect. Continued use after changes become effective constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except for claims that may be brought in small claims court. You waive the right to participate in class action lawsuits.
